Shawn Morris and Matthew Yarling successfully represent amicus curiae in McMillin Companies, LLC v. American Safety Indemnity Co. (D063586) resulting in a published decision holding that, in a bad-faith action against a non-contributing additional insurer, developers may present their entire damages claim to the jury, even when the contributing additional insurers’ payments have exceeded the total defense costs -- thereby setting a beneficial precedent for developers in additional insured coverage disputes.

Shawn Morris, Greg Soldner and co-counsel Dave Peters of Peters & Freedman win jury verdict in a California Civil Code Section 896 construction defect case styled as Acqua Vista Homeowners Association v. MWI, Inc and Standard Plumbing & Industrial Supply Company, Inc. The jury trial lasted 14 days and involved claims of leaking and corroding Chinese cast iron waste and drain pipe in a 382 unit, 18 story high rise building, located in downtown San Diego.

Shawn Morris and Greg Soldner successfully defend a developer and general contractor in a California Civil Code Section 896 construction defect case styled as Treo Maintenance Association v. Brookfield Woodbury LLC. The trial lasted 21 court days with the plaintiff homeowner association seeking in excess of $7,500,000.00 claiming multiple construction violations. The verdict was a huge victory for Shawn and Greg and the client and represents one of California’s first SB 800 trials.

Will Lemkul settles complex construction defect claim for Rancho California RV Owners Association after five (5) weeks of trial. The trial involved construction defects in excess of six million dollars. The terms and amount of the settlement are confidential.

Pierce Andrews passes Patent Bar

Will Lemkul settles case in Las Vegas, Nevada involving a large builder of a custom home. The case involved various architectural, plumbing, electrical, grading and drainage defects. The primary issue in the case was the defective construction of an underground basement that permitted water intrusion resulting in mold and various other damages.

Will Lemkul resolved a Trademark Infringement Claim filed against MVP Group International ("MVP"). Despite being named as a defendant in the case, Will was successful in obtaining a full dismissal and approximately a quarter million dollars in settlement in favor of MVP.
